Africar – Terms and Conditions
These Terms and Conditions (“Agreement”) apply to all vehicle rentals from Africar Ltd (“Africar”, “we”, “us”, “our”). By renting a vehicle from Africar, the renter (“you”, “your”) agrees to the terms below. Please read carefully before confirming your booking.
1. Rental Requirements
- Drivers must be at least 21 years old and hold a valid driver’s license with a minimum of 2 years of driving experience.
- An International Driving Permit (IDP) is required for foreign drivers if the local license is not in English or French.
- A valid passport or national ID must be presented at vehicle pickup.
2. Payment and Security Deposit
- A security deposit (amount depending on vehicle type) is required at the start of the rental, payable by cash, Mobile Money, or credit card.
- The deposit will be refunded after vehicle inspection upon return, provided no damage, loss, or additional charges apply.
- Payment for the rental may be made in advance or at vehicle pickup.
3. Vehicle Use
- The vehicle must be used responsibly and only by authorized drivers listed in the rental agreement.
- The renter agrees not to use the vehicle for:
- Transporting passengers or goods for hire
- Off-road driving (unless permitted)
- Racing, towing, or illegal activities
- The renter must comply with all local traffic laws and parking regulations.
4. Insurance and Liability
- All Africar vehicles include basic insurance coverage (third-party liability).
- Optional coverage, such as Collision Damage Waiver (CDW) or Theft Protection, can be added to reduce financial responsibility in case of accident or theft.
- The renter remains liable for damages resulting from negligence, unauthorized use, or violation of traffic laws.
5. Fuel Policy
- Africar operates on a Full-to-Full policy: the vehicle is delivered with a full tank and must be returned the same way.
- Missing fuel will be charged based on the current rate plus a refueling fee.
6. Mileage and Usage
- Unless stated otherwise, rentals include unlimited mileage within Rwanda.
- Cross-border travel is not allowed unless approved in writing by Africar.
7. Breakdown or Accident
- In case of a breakdown or accident, contact Africar’s 24/7 assistance immediately.
- Obtain a police report for any accident, even minor ones.
- Do not authorize repairs or towing without Africar’s consent.
8. Vehicle Return
- Vehicles must be returned on the agreed date, time, and location as specified in the rental contract.
- Late returns may result in additional hourly or daily charges.
- The renter must return the vehicle in the same condition as received, excluding normal wear and tear.
- Africar reserves the right to inspect the vehicle before releasing the deposit.
9. Cancellations and Refunds
- Cancellation more than 72 hours before pickup: Full refund (minus RWF 10,000 processing fee).
- Cancellation 24 to 48 hours before pickup: refund less a 50% handling fee.
- Cancellation less than 24 hours before pickup or no-show: No refund.
All refunds are subject to a processing fee of RWF 10,000.
10. Africar Drivers
- Africar offers optional professional drivers for daily or long-term rentals.
- Drivers provided by Africar are trained, insured, and familiar with local routes.
- Clients remain responsible for ensuring safe passenger behavior and compliance with rental conditions.
11. Personal Belongings
Africar is not responsible for loss or damage to personal items left in the vehicle during or after the rental period.
12. Force Majeure
Africar shall not be liable for delays or non-performance due to circumstances beyond its control (e.g., natural disasters, road closures, strikes, accidents, etc.).
13. Governing Law
This agreement is governed by the laws of the Republic of Rwanda. Any disputes arising shall be subject to the jurisdiction of Rwandan courts.
